ACLU of Arizona to Challenge Ban on Sale of Anti-War Shirts

The request by Plaintiff Dan Frazier for a Preliminary Injunction in the case of Frazier v. Boomsma, et al, Case No. 07-CV-8040, will be heard by U.S. District Court Judge Neil V. Wake at 2:00 pm on Thursday, August 23, 2007, in the federal courthouse in Phoenix.

Dan Frazier is the one scheduled witness. He is asking that the Court stay the effective date of the Senate Bill 1014 until a determination has been made as to the constitutionality of this legislation in this lawsuit. The ACLU of Arizona is representing Dan Frazier and, as seen in the below Motion, maintains that the Senate Bill clearly violates Mr. Frazier’s First Amendment rights of free speech and expression, and is an attempt by the Arizona Governor and legislature to keep the human toll of the Iraq War out of the public discourse.

I think that they, the plaintiff, will win. I can’t believe that the legislature fell for the line of BS they were fed. Michael Bryan has been quite blunt with the state legislators that have come to Drinking Liberally here in Tucson about their vote for this issue. Lopes regrets his vote and admits his mistake. Serandnik (sp?) fell for the line of BS that a person’s name is copyrighted.

Sorry, but the name appeared in the public record, the listing of that name on a shirt is NOT a violation of privacy of copyright infringement. She used the example that Elvis Presley’s name is copyrighted. She is WRONG, his LIKENESS and the SCRIPT form of his name is copyrighted, not his name per se.

sorry but this has nothing to do with freedom of speech! This has to do with a librial who belongs to a group that screams and rants about big busness in the war. then charges $22 for a t-shirt with the names of our proud dead.Talk about shitting on our sons for the almighty dollar! Frazier is not political, he is a profiter!I only hope his family never see’s his name on a shirt. Then again, He would never stand that tall would he?
